When you perform something without paying for it, you are stealing from whoever wrote it.
Just so. Singing "Happy Birthday" at your son's birthday party is a clear violation because you could have purchased a CD of someone singing it, but chose to deprive the copyright holder (not likely the author or even her estate), the artist and the publisher instead.
I think I'll write the RIAA suits and get their take on this one. They'll probably tell me to cease and desist singing Happy Birthday forthwith.
