When my tuba fell out of a plane's cargo hold and sustained a great deal of damage, the airline claimed they were not responsible. The Musician's union took up my cause; something along the lines of "claiming no responsibility doesn't mean you aren't liable". If a handler is negligent in his work the company MUST wear the responsibility.

They ended up paying $900 for a new case for me (that wasn't covered by my insurance) when I mentioned that our orchestra would change to another airline for our next tour.

I've since bought a flight case, as added insurance!!
