Does an audition count as a public performance? Say someone wishes to take an audition, but one of the required pieces is out of print, or cannot be bought in the U.S. Let's say Prokofiev 5 is on the audtion. (last time I checked, Russian music still cannot be bought in the U.S. meaning, one would have to search high and low for the old book of Prokofiev symphonies, which is impossible to find these days because "everyone" has exhausted the left over supply from before this trade-mess occured. Some one PLEASE let me know if I'm mistaken.)

...So, our friend stumbles onto a COPY of Prok. 5. Is it legal for him/her to use this copy for the audition? Not a performance with the orchestra (because the orchesras have the money to RENT the parts) just an audition for the job.
